A motorcyclist who was racing another on Canton Road in Marietta Wednesday night was killed when he fell off and was struck by a car, Cobb County police said. Police did not release the name of the deceased, pending notification of his family.
The other motoryclist, David James Tipton, 34, of Marietta was charged with vehicular homicide, racing, reckless driving and DUI following the 10:45 p.m. accident.
According to police, Tipton was riding a 2004 Honda VFR800 and racing a 2007 Suzuki GSXR 1000 northbound on Canton Road. The Suzuki rider was weaving in and out of traffic when he clipped the rear of a Mercury Villager van. The collision redirected him to the southbound lanes, where he fell off the bike and was hit by a Toyota Camry.
He was pronounced dead at the scene.

Wonder how they rationalize Tipton being charged with vehicular homicide. He wasn't responsible for the other guys death. He made his own decision to ride his bike in a foolish manner and now he has paid the ultimate price for it.

I don't understand why he would be charged with vehicular Homicide either. 2 bikes, 2 independant people making the decision as to how they ride them. Tipton didn't force the other rider into the car, or reach over and pin his throttle etc...
However the laws are not exactly logical at all times, but for a good cause. The law could actualy be that "if you race on a public road, and the other guy gets killed, you will be charged for his death from having an active involvement in the situation". IMO it sounds fair if you put it that way. It discourages road racing too, knowing that you are just as responsible for the other rider as much as you are yourself.
